importantes d\u00e8s 2025 pour les ergoth\u00e9rapeutes ind\u00e9pendant\u00b7e\u00b7s<\/span><\/h3>\n<p class=\"text\">En 2025, de nouvelles dispositions l\u00e9gales entrent en vigueur concernant l\u2019admission \u00e0 pratiquer \u00e0 la charge de l\u2019AOS et l\u2019autorisation de pratiquer, pour lesquelles s\u2019appliquaient jusqu\u2019\u00e0 pr\u00e9sent des dispositions transitoires. Nous vous prions de lire attentivement ces nouveaut\u00e9s afin de pouvoir entamer \u00e0 temps les d\u00e9marches n\u00e9cessaires pour exercer votre activit\u00e9 dans le respect des normes en vigueur.<\/p>\n<h4 class=\"text\">Les modifications suivantes entrent en vigueur \u00e0 compter du 1er janvier 2025:<\/h4>\n<ol>\n<li><span class=\"bold\"><strong>Admission \u00e0 l\u2019AOS et conservation des droits acquis<\/strong><br \/>\n<\/span>La conservation des droits acquis ne concerne que le territoire du canton o\u00f9 l\u2019admission a eu lieu et n\u2019est valable que tant que la situation ne change pas. Si des ergoth\u00e9rapeutes ou une organisation d\u2019ergoth\u00e9rapie ont factur\u00e9 \u00e0 la charge de l\u2019AOS\u00a0<span class=\"bold\"> avant le 1er janvier 2022<\/span> , ils\/elles peuvent continuer \u00e0 le faire dans le canton d\u2019admission sans devoir demander une nouvelle admission \u00e0 pratiquer \u00e0 la charge de l\u2019AOS. Toutefois, \u00a0<span class=\"bold\">si la forme juridique est modifi\u00e9e<\/span>\u00a0 (p. ex. un\u00b7e ergoth\u00e9rapeute employ\u00e9\u00b7e dans une organisation b\u00e9n\u00e9ficiant de droits acquis se met \u00e0 son compte) ou si la facturation \u00e0 la charge de l\u2019AOS doit se faire dans un autre canton, \u00a0<span class=\"bold\">une demande d\u2019admission \u00e0 pratiquer \u00e0 la charge de l\u2019AOS doit \u00eatre d\u00e9pos\u00e9e selon le nouveau droit.<\/span><br \/>\nSelon\u00a0 <a href=\"https:\/\/ergotherapie.ch\/wp-content\/uploads\/2025\/02\/2023_FAQ-LAMal-admission-des-fournisseurs-de-prestations.pdf\">la FAQ de l\u2019OFSP<\/a> (question 1.1, let. e), aucune proc\u00e9dure simplifi\u00e9e n\u2019est pr\u00e9vue dans ce cas, comme cela s\u2019applique pour l\u2019autorisation de pratiquer la profession dans un cas analogue.<\/li>\n<li><span class=\"bold\"><strong>Fin de la p\u00e9riode transitoire pour l\u2019autorisation de pratiquer<\/strong><br \/>\n<\/span>La loi sur les professions de la sant\u00e9 (LPSan, art. 34, al. 2) pr\u00e9voit une p\u00e9riode transitoire de cinq ans pour les personnes qui, avant l\u2019entr\u00e9e en vigueur de la LPSan, n\u2019avaient pas besoin d\u2019une autorisation de pratiquer la profession selon le droit cantonal. <span class=\"bold\">Ce d\u00e9lai a expir\u00e9 le 1er f\u00e9vrier 2025. A partir de cette date, ces ergoth\u00e9rapeutes auront \u00e9galement besoin d\u2019une autorisation.<\/span>\u00a0Etant donn\u00e9 que la LPSan ne d\u00e9finit pas pr\u00e9cis\u00e9ment la notion d\u2019exercice \u00absous propre responsabilit\u00e9 professionnelle\u00bb, il existe diff\u00e9rentes interpr\u00e9tations cantonales. <strong>Veuillez vous renseigner aupr\u00e8s du canton o\u00f9 vous exercez<\/strong> pour savoir \u00e0 partir de quand l\u2019exercice de la profession est consid\u00e9r\u00e9 comme \u00absous propre responsabilit\u00e9 professionnelle\u00bb.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<h4>Exercice sous propre responsabilit\u00e9 professionnelle<\/h4>\n<p>La notion <strong><span class=\"bold\">d\u2019\u00abexercice sous propre responsabilit\u00e9 professionnelle\u00bb<\/span><\/strong>\u00a0 s\u2019applique \u00e0 toute activit\u00e9 pratiqu\u00e9e sans le contr\u00f4le d\u2019un membre de la m\u00eame profession, que cette activit\u00e9 soit salari\u00e9e (au sein d\u2019une entreprise publique ou priv\u00e9e) ou ind\u00e9pendante. L\u2019\u00e9l\u00e9ment cl\u00e9 est celui de la responsabilit\u00e9 finale incombant \u00e0 une personne pour sa propre activit\u00e9 professionnelle et, le cas \u00e9ch\u00e9ant, pour celle de ses collaborateur\u00b7rice\u00b7s. Ce sont donc les personnes install\u00e9es \u00e0 leur propre compte qui doivent disposer d\u2019une autorisation de pratiquer, ainsi que les cadres, dans les institutions de soins, assumant la responsabilit\u00e9 professionnelle du travail de leurs subordonn\u00e9\u00b7e\u00b7s.
