per fatturare le prestazioni a carico dell\u2019assicurazione malattie, infortuni e invalidit\u00e0?<\/p>\n<ol>\n<li>Autorizzazione all\u2019esercizio della professione (AEP) della direzione cantonale della sanit\u00e0 per il libero esercizio come ergoterapista o come<br \/>\norganizzazione di ergoterapia, compresa l\u2019autorizzazione AOMS (assicurazione obbligatoria delle cure medico-sanitarie)   <h3>Adesioni alle convenzioni tariffali<\/h3>\n<p>Per poter fatturare le prestazioni di ergoterapia \u00e8 necessario aderire alle convenzioni tariffali delle assicurazioni malattie e alla convezione CTM (AI, AINF, AM).<\/p>\n<p><em>Conformemente all\u2019articolo 4 delle direttive sulla convenzione tariffale, la tassa di adesione unica ammonta a CHF 200.\u2013*. ergoterapiste e gli ergoterapisti indipendenti<\/span><\/h3>\n<p class=\"text\">Nel 2025 entreranno in vigore nuove disposizioni di legge per le autorizzazioni AOMS e l\u2019autorizzazione all\u2019esercizio della professione. Vi preghiamo di leggere con attenzione le novit\u00e0 illustrate, in modo da poter continuare a esercitare la vostra attivit\u00e0 in modo conforme alla legge.<\/p>\n<h4 class=\"text\">Le modifiche seguenti entreranno in vigore il 1\u00b0 gennaio 2025:<\/h4>\n<ol>\n<li><span class=\"bold\"><strong>Autorizzazione AOMS e garanzia dei diritti acquisiti<\/strong><br \/>\n<\/span>I diritti acquisiti si riferiscono esclusivamente al territorio del Cantone che ha rilasciato l\u2019autorizzazione e valgono solo finch\u00e9 non cambiano le condizioni. Se una o un ergoterapista o un\u2019organizzazione di ergoterapia &nbsp;<span class=\"bold\">esercitava a carico dell\u2019AOMS prima del 1\u00b0 gennaio 2022<\/span>&nbsp;, pu\u00f2 continuare a farlo nel rispettivo Cantone senza dover richiedere una nuova autorizzazione AOMS. Tuttavia, se viene &nbsp;<span class=\"bold\">modificata la forma giuridica<\/span>&nbsp; (ad es. un\u2019ergoterapista assunta presso un\u2019organizzazione con diritti acquisiti avvia un\u2019attivit\u00e0 indipendente) o si vuole esercitare a carico dell\u2019AOMS in un altro Cantone, &nbsp;<span class=\"bold\">occorre richiedere un\u2019autorizzazione AOMS secondo il nuovo diritto.<\/span><br \/>\nIn base alle&nbsp;<a class=\"link target_blank\" href=\"https:\/\/backend.bag.admin.ch\/fileservice\/sdweb-docs-prod-bagadminch-files\/files\/2025\/03\/18\/a81a61e1-6877-4e19-a801-c20d959e8105.pdf\" target=\"_blank\" rel=\"noopener\"> FAQ dell\u2019UFSP<\/a> (domanda 1.1, lett. e), in questo caso non \u00e8 prevista una procedura semplificata come accade in una situazione analoga per l\u2019autorizzazione all\u2019esercizio della professione.<\/li>\n<li><span class=\"bold\"><strong>Termine del periodo di transizione per l\u2019autorizzazione all\u2019esercizio della professione<\/strong><br \/>\n<\/span>La legge federale sulle professioni sanitarie (LPSan, art.\u00a034\u00a0cpv.\u00a02) prevedeva un periodo di transizione di cinque anni per chi, prima della sua entrata in vigore, non necessitava di un\u2019autorizzazione all\u2019esercizio della professione secondo il diritto cantonale. <span class=\"bold\">Il periodo di transizione \u00e8 scaduto il 1\u00b0 febbraio 2025. A partire da questa data, anche le ergoterapiste e gli ergoterapisti nella situazione di cui sopra devono disporre di un\u2019apposita autorizzazione.<\/span>&nbsp;Poich\u00e9 la LPSan non definisce in modo preciso il concetto di \u00absotto la propria responsabilit\u00e0 professionale\u00bb, esistono diverse interpretazioni a livello cantonale. <strong>Vi preghiamo di informarvi presso il Cantone in cui praticate la vostra professione<\/strong> per capire in quali situazioni si parla di esercizio della professione \u00absotto la propria responsabilit\u00e0 professionale\u00bb.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<h4>Esercizio della professione sotto la propria responsabilit\u00e0 professionale<\/h4>\n<p>La nozione di <strong><span class=\"bold\">\u00abesercizio della professione sotto la propria responsabilit\u00e0 professionale\u00bb<\/span><\/strong>&nbsp; comprende tutte le attivit\u00e0 esercitate sia come dipendente (presso un\u2019azienda pubblica o privata) sia come indipendente senza la supervisione di un\u2019altra persona che svolge la medesima professione. La cosa essenziale \u00e8 che la o il professionista della salute assuma personalmente la responsabilit\u00e0 professionale finale della propria attivit\u00e0 e quella delle sue eventuali collaboratrici o collaboratori. Devono pertanto disporre di un\u2019autorizzazione all\u2019esercizio della professione sia coloro che lavorano in uno studio proprio sia le e i dirigenti di istituti di cura che hanno la responsabilit\u00e0 professionale del corretto esercizio della professione da parte delle persone a loro sottoposte. Lo stesso vale per chi lavora alle dipendenze di una struttura come unica o unico specialista della rispettiva professione sanitaria e svolge quindi la propria attivit\u00e0 senza alcuna supervisione professionale (ad es. persona che opera all\u2019interno di uno studio medico associato come unica ergoterapista).<\/p>\n        <\/div>\n    <\/div>\n<\/div>\n\n\n        <div
